1. Introduction

These Terms of Service ("Terms") govern your access to and use of the Friendify platform, websites, dashboards, APIs and Discord bots (collectively, the "Service"). By using the Service, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree with any part of these Terms, you must discontinue use of the Service immediately.

2. Services We Provide

Friendify offers the following services:

AI-powered conversational bots for Discord
Custom personality & context management
Voice transcription (Whisper & Faster-Whisper)
Text-to-speech audio playback and voice synthesis
Real-time speech-to-text and text-to-speech processing
Embeddings, memory and learning modules
Mood & sentiment detection
Real-time communication via WebSockets
Bot hosting, uptime monitoring & system health checks
Coupon, billing and payment handling

3. Eligibility & Account Obligations

You must be at least 16 years old (or older if required by your local law).
You are responsible for safeguarding your Discord and Friendify credentials.
You must comply with Discord's Terms of Service and Community Guidelines.

4. Acceptable Use

You agree not to:

Deploy bots that violate law, promote hate, harass or exploit children.
Upload or process content you do not have rights to use.
Attempt to reverse-engineer, scrape or overload the Service.
Circumvent plan limits, rate limits, security mechanisms or payment obligations.

5. Plans, Payments & Coupons

Free, Premium and Enterprise plans each carry separate message, audio and bot limits.
Paid plans are billed in advance. Taxes may apply.
Coupons grant discounts only within their stated validity period.
Failed or disputed payments may result in account suspension.

5B. Prohibited Content & Activities

In addition to the Acceptable Use Policy, the following are expressly forbidden:

Hate speech or content that promotes discrimination or violence.
Exploitation or sexualisation of minors.
Malware, phishing, spam or fraudulent schemes.
Generation or dissemination of copyrighted material you do not own.
Disclosing personal data of private individuals without consent (doxxing).
Using the Service for real-time life-critical systems (e.g., medical diagnosis, autonomous vehicles) without a separate written agreement.
Attempting to probe, scan or compromise platform security.
Violation may result in immediate suspension and referral to law enforcement where appropriate.

6. Intellectual Property

Friendify, its logo and underlying software remain our exclusive property.
You own the Discord content you supply and the personalities you create.
Reverse engineering or reproducing our software is prohibited.

7. AI Output & Disclaimer

AI responses are generated autonomously. While filters are applied, we cannot guarantee factual accuracy or suitability. You are solely responsible for any content your bots publish.

8. Service Level & Support

99.9% monthly uptime target.
Planned maintenance will be announced in advance where reasonable.
Support available at support@friendify.net. Premium & Enterprise tiers receive priority support.

9. Termination

You may cancel at any time via the dashboard; service continues until the end of your current billing period.
We may suspend or terminate your account for violations of these Terms or applicable law.
Data associated with terminated accounts is deleted within 30 days unless legally required otherwise.

10. Limitation of Liability

Friendify will not be liable for indirect or consequential damages, data loss or lost profits.
Our aggregate liability is limited to the fees you paid to us in the preceding 12 months.

11. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Republic of Türkiye.
İstanbul Courts have exclusive jurisdiction. We encourage amicable resolution first.

12. Changes to These Terms

We may update these Terms with 30 days' notice via e-mail and on our site.
Continued use after the effective date constitutes acceptance.
